If you file bankruptcy in Nebraska, does your spouse have to file with you? The answer to that question is no. There is no requirement that your spouse be a party to the bankruptcy case. Keep in mind, that your spouse may be legally liable for certain debts even though they come in your name alone. In particular, medical debts are considered "necessities of life" and your spouse is liable for medical debts you incur during the marriage. Your spouse is not liable for debts you incur prior to the marriage.
